LECTURE: Expert Witness: Evidence in International Arbitration
IMarEST TV recording by the Midlands Branch on the 26th April 2023. This lecture was presented by Dr Alan Ma of Birmingham City University.
Unlike litigation in a national court, arbitration has the flexibility to adopt or modify it's procedure in accordance with the circumstances of the matter. In this lecture, the speaker explains the current procedure for giving evidence in court proceedings.
Whilst fully complying with the rules of national justice and the cardinal principles of arbitration, the speaker discusses the adoption of robust and pragmatic approaches in giving expert evidence in international arbitration, improving the efficiency of the dispute resolution process. Ideas of how to extend these efficiencies in the ever-growing popularity of arbitration in the digital era are also explored.
